Armenia as an option for surrogacy

Surrogacy in Armenia has been permitted since 2002 under the Law “On Reproductive Health and Reproductive Rights of the Human Being” and is available to both Armenian citizens and foreigners: heterosexual married couples, civil partnerships, and single women and men wishing to become a mother or father. Armenia opens the path to parenthood through surrogacy provided that just two mandatory conditions are met:

Medical grounds (the programme is not intended for those who simply do not wish to go through pregnancy and childbirth themselves)
Genetic relationship between at least one parent and the child.

In the case of single women and men, the programme is only permitted using their own eggs/sperm.

The country’s legislation supports intended parents and reliably protects their parental rights from the moment the contract is signed: a surrogate mother in Armenia has no rights over your child and cannot challenge your rights in court.

Armenia is a legally secure “safe haven” for commercial surrogacy, with no grey areas or conditions written in small print. The legal situation in Armenia: support for intended parents

Armenian legislation provides a simple and transparent framework for surrogacy, where the rights of the intended parents are protected and the procedure takes a minimum of time. The birth certificate is registered within a few days, and the surrogate mother cannot change her mind.

Important legal details to be aware of:

In 2025, the Constitutional Court of Armenia ruled that age restrictions for women using ART were unconstitutional, so there are no longer any formal upper age limits.
Treatment using IVF and other ART methods is fully legal and widely used through the ‘Ukraine–Armenia’ hybrid programme. Please do not confuse this with illegal cross-border schemes: we offer a guaranteed birth of a child thanks to advanced reproductive medicine in Ukraine, and we will arrange for the birth of your child in Armenia according to your wishes.

Requirements for surrogacy in Armenia

Surrogacy for heterosexual couples /single men/single women is permitted for both Armenian citizens and foreigners. However, there is an important caveat: the law does not permit surrogate mothers who are Armenian citizens to carry a child for single foreign nationals. In practice, this means that a surrogate mother in Armenia for a single client must be sought outside the country.

Requirements for a surrogate mother in Armenia:

Age: 20–38 years.
Must have at least one healthy child born naturally.
No medical or psychological contraindications.
Written consent from her husband, if she is married.

The requirements are standard and are no different from those in other countries where surrogacy is permitted. However, intended parents may face risks:

a large number of fly-by-night clinics and agencies set up to meet the increased demand for reproductive procedures;
the lack of guaranteed programmes with a birth outcome, fixed-price contracts and affordable rates;
the recruitment of vulnerable surrogate mothers from poor Asian countries into programmes.

By participating in the “Ukraine – Armenia” programme, you can be confident that the surrogate mother provided to you has a stable life situation, a clean legal record, and has been approved for the programme by doctors and a psychologist from the Feskov Human Reproduction Group. Brief description of the surrogacy process

The journey to parenthood through surrogacy in Armenia under our programme can take approximately 2 years: depending on your reproductive potential (quality of eggs and sperm, whether donor oocytes/donor sperm will be required), your desire to have a child of a specific gender, and your individual preferences. The programme comprises several stages:

Stage 1. Analytical

You receive a free consultation with our lawyer to discuss the best country for the birth of your child, taking into account your nationality, family status and the specific legal requirements in your country. Following the consultation with the lawyer, you will work with your doctor to plan and approve a medical plan: you will undergo examinations, receive an assessment of your reproductive potential (quality of oocytes and sperm), and, if necessary, you may pre-select a donor matching your phenotype from the clinic’s dynamic database.

Once we have received the results of the semen analysis and prepared the logistics for the transport of your cryopreserved oocytes/sperm/embryos (if required), we can proceed to signing the contract.

Before signing the contract, you are welcome to visit us to get to know us and see for yourself that the clinic meets high standards, and that our legal team has extensive experience and a track record of many successful cases similar to yours. Stage 2. Embryo creation (2–12 months)

The duration of this stage is always individual: for some couples, 2–3 months is sufficient to obtain embryos and achieve a successful transfer, whilst others require several attempts and a little more time. We base our estimates on actual timelines derived from the experiences of our patients, who have gone on to become happy mums and dads.

We will provide single intended mothers with photographs of donors who match their desired phenotype and characteristics.

We prefer fresh rather than frozen eggs. However, our clinic also operates its own oocyte cryobank.

In accordance with the programme protocol, we obtain embryos from the parents’ gametes or using donor material. To ensure the birth of a healthy child, PGD (pre-implantation genetic testing) is carried out during the embryo formation stage – this rules out chromosomal abnormalities. A welcome feature of this procedure for intended parents is the opportunity to find out the baby’s sex.

If you need to transport ready-to-implant embryos from another clinic, we will organise the preparation of the full set of documents required for legal import into Ukraine, liaise with your clinic, handle logistics, and communicate with couriers and lawyers. All you need to do is sign an authorisation letter.

We will provide you with a prepared surrogate mother to whom one embryo will be transferred. The number of transfer attempts is not limited under the terms of the programme: we will carry out as many as necessary to ensure you have a baby. This is our contractual guarantee – you will not be required to pay any additional fees in the event of an unsuccessful IVF procedure.

Stage 3. Pregnancy monitoring (9 months)

Once pregnancy is confirmed, we will transfer the surrogate mother to a safe region of Ukraine (the city of Chernivtsi, 30 km from the Romanian border). There, safe and far from the war zone, she will be under the supervision of our doctors and coordinators for the transfer to Armenia for the birth (approximately up to 25–30 weeks, depending on the obstetric situation). After this period, the surrogate mother travels to Armenia, where she will give birth to your baby.

The birth will take place in a private perinatal centre, either naturally or by caesarean section (the decision will be made by the doctor based on the obstetric situation), in the presence of the intended parents. An unforgettable moment awaits the biological mother – holding her baby to her breast immediately after birth.

We will provide you with comprehensive support during this special moment and take care of organising meals. All that will be left for you to do is enjoy this long-awaited moment of pure happiness.

From the maternity hospital, you and your baby will be taken to the apartment of your choice, where everything you need for your little one will be waiting for you.

Stage 4. Legal support in Armenia (1–5 working days + the time taken to obtain a travel document from the embassy)

After the birth of the child and your visit to the civil registry office, you will be referred for a DNA test at a state laboratory, which will take several working days. Only after this, upon confirmation of the genetic link, will the Ministry of Justice be authorised to register the married couple/single father/single mother as the child’s parents.

A lawyer in Armenia, in coordination with our lawyers, will begin the process of legalising your child. You do not need to pay our lawyers anything extra: their services are included in the programme cost. A set of documents will be prepared for the registration of the birth certificate, in which you will be listed as the legal parents.

The birth certificate is registered very quickly, usually the day after the child is born. Occasionally, there may be a delay of one or two working days.

We will attach a set of documents (certified and apostilled) to the birth certificate for your country’s embassy and for the issuance of the child’s passport or travel document for their return to your country.

Important: EU citizens will need go to embassy, after registering the birth certificate in order to obtain a passport or travel document for the child.

If a simplified adoption procedure is required in your country (depending on your nationality), we will assist you in successfully completing it.

Once you have the child’s passport or travel document and the birth certificate (with an apostille and translation), you can return home.

Important note for parents with citizenship of the EU: recognising parenthood in your country and obtaining citizenship for the child will require additional procedures. You will need a lawyer specialising in international reproductive law. Feskov Human Reproduction Group will provide you with such a lawyer, who will support your case until your child is recognised as a citizen of your country.
