Surrogacy in the Czech Republic: New Rules from 2026

As of July 1, 2026, the regulations on surrogacy in the Czech Republic will change. The final version of the law introduces several restrictions for the process. The Feskov Human Reproduction Group has compiled comprehensive information on this topic and selected alternatives for intended parents interested in surrogacy in the Czech Republic.

Legal Amendments: Surrogacy in the Czech Republic is only possible for female citizens.

The updated provisions clearly define all the conditions for providing the service. For foreign citizens seeking surrogacy in the Czech Republic, the most complex requirement is now the following:

Permanent Residence Permit (PR)

The law requires Czech citizenship or permanent residence (Trvalý pobyt) for at least three years at the start of the program. Refugees with temporary protection (Strpění) are not eligible for surrogacy in the Czech Republic. Likewise, it is not available to Czech surrogates if you have not lived in the Czech Republic for at least three years.

The changes also affected the principle of establishing kinship for a surrogate-born child in the Czech Republic:

"Social contacts" are more important than biological contacts.

Even with a one hundred percent genetic match with the biological parents, a Czech court can refuse to legalize the child if the couple does not plan to live permanently in the Czech Republic. A specially appointed state guardian (OSPOD) now regulates the kinship procedure.

Court fee 150,000 CZK

A special court fee of approx. 6,000 € was introduced for foreign couples without permanent residence (or with less than three years of residence). This fee is non-refundable, even if the application is rejected. This measure represents a prohibitive barrier for surrogacy in the Czech Republic and deters couples seeking court recognition of their relationship.

Changes are also being introduced for Czech surrogates:

Financial monitoring over 2 years

Banks are obliged to monitor the accounts of the surrogate mother in the Czech Republic for two years after the birth. The anti-money laundering system flags suspicious transfers as "proceeds of human trafficking."

Furthermore, if your surrogate mother came to the Czech Republic as a citizen of a country involved in a military conflict or in an economic crisis, the public prosecutor's office will classify her as a "person in a vulnerable situation." This turns the contract for carrying a child into exploitation of vulnerable persons and thus into criminal proceedings.

Blacklist of Clinics and Agencies

The Czech Ministry of the Interior has created a register of foreign clinics offering surrogacy services in the Czech Republic. If a clinic is on this list, couples applying through that clinic will automatically be denied legalization of the marriage/partnership, and the case will be reported to the police.

FROM July 1, 2026, surrogacy in the Czech Republic will be practically impossible for foreign citizens. A birth in the Czech Republic with the aim of obtaining a Czech birth certificate through the Czech surrogacy program will no longer be a realistic option.

Czech Surrogacy: Legal Situation Before the Law Changes

To allow a comparison, let's look at how surrogacy in the Czech Republic worked before the legal changes.

Until 2026, only non-commercial surrogacy was permitted in the Czech Republic. Only the reimbursement of reasonable expenses during pregnancy (food, transport, medical treatments) was allowed.

Legally, a surrogate mother in the Czech Republic had undeniable parental rights to the child she was carrying and the child she gave birth to. Theoretically, she could change her mind and keep the child; in this case, the court would rule entirely in her favor. However, no one was obliged to reimburse the parents for the expenses incurred.

Thus, the transaction between parents and a surrogate mother in the Czech Republic was only completely safe for the surrogate mother.

From 2026, these risks will be further exacerbated by legal restrictions, making surrogacy in the Czech Republic practically impossible for foreigners. However, there are various ways to ensure happy parenthood. We present the best of these to you below.

Reliable and Affordable Surrogacy Programs

The main advantage of surrogacy programs in the Czech Republic was the lower cost compared to other European countries, as well as the excellent medical care. However, in the Czech Republic, neither surrogates nor the service itself are available. The solution is to find a similar service in another country at a lower cost.   • The legislation is stable and favorable for biological parents;
  • There is no risk of the surrogate refusing to hand over the child;
  • Transparent legal process without "surprises";
  • Fast document processing (not months, but weeks).
