SURROGACY.RU about surrogacy services in Ukraine – intentional disinformation?

The SURROGACY.RU website has recently addressed the publication of another farfetched text whose authors continued their so called investigation of a “critical” situation in the area of surrogacy services in Ukraine. 
 
The fact is that the authors who did this “fundamental” work and placed their article at the surrogacy.ru website did not even make a good try to go into the heart of the matter. 
 
First, having based the scenario of their publication on the ideas of scandal events that were reported many times by the Russian mass media, the SURROGACY.RU journalists just committed the act of banal plagiarizing. 
 
Second, every scene relating to the subject, which inspired SURROGACY.RU journalists to write this article, was laid in the territory of Russian Federation. 
 
Third, all the differences between Russian and Ukrainian legislative regulations pertaining to surrogacy programs demonstrate considerable advantages of the laws of Ukraine. 
 
If, according to Article 51 of the Family Code of Russian Federation, a married couple who agreed that an embryo be implanted to a woman with the pregnancy carrying purpose can be registered as the parents of the child only provided that such a woman gives her consent thereto, Article 123 of the Family Code of Ukraine expressly defines a married couple who had recourse to the service of a surrogate mother as the parents of a child to be born as a result of application of reproductive techniques. 
 
Those particular differences between the active laws in the two countries rule out a slightest chance for any such situation to generate in Ukraine, i.e. the situation to which the attention of SURROGACY.RU readers was drawn. 
 
Indeed, no ambiguous conclusion as regards the origin of a child conceived with the use of reproductive methods is just possible! 
 
Therefore, it appears quite evident that an attempt made by SURROGACY.RU journalists to implant the Russian scenario into the reality of Ukraine is just the demonstration of their incompetence. To make matters even more clear, a mysterious criminal syndicate combining representatives of justice authorities, law-enforcement bodies, a surrogate mother and her husband who seek to extort forty or fifty thousand Euro from the Italian couple could be nothing but a product of fevered imagination of the surrogacy.ru authors.
 
As regards the appearance of the surrogate mother and her husband on television, it may be noted that the SURROGACY.RU journalists did not even take the trouble of inventing a story and just borrowed the plot from Malakhov’s show “Let them Talk”. 
 
In order to create a reader’s negative impression about Ukraine, SURROGACY.RU journalists go into lengthy description of “weepy emotional experience” of the Italians – genetic parents of the child – who found themselves in a cold-hearted and inhuman environment of Ukrainian bureaucrats. 
 
In this case, the article authors excessively infatuated with the idea of blowing up negative information contained in the text do not even notice the fact that their publication bristles with contradictions. 
 
Thus, for example, if at the start of their “interview” the Italians say that it was rather hard for them to find the way to visit Ukraine for two days to continue the medical part of the program, it suddenly turns out at the end of publication that they have been staying in Ukraine for more than seven months. 
 
Meanwhile, the “malicious” Ukrainian functionaries, surrogate mother and her spouse just can’t wait to see the ever-active Italians leaving Ukraine, so that they can feel free to place the child in an orphanage. 
 
It is a pity that the “investigation” made by the SURROGACY.RU journalists fails to give answers to the following questions: 
  • What benefit could the “extorters” derive from placing the child in an orphanage? 
  • If the child is placed in an orphanage, would they be able to collect 50,000 EUR and who would pay them the money? 
  • And if it is so necessary that the Italians leave Ukraine, so that the cherished sum of money can be received, wouldn’t it be much easier for the “spiteful” bureaucrats just to banish them from the country on solid legal grounds? Indeed, the Italians exceeded at least twice the time of their formal stay, as prescribed by the laws of Ukraine. 
  • Why had the surrogate mother and her husband to forge the child birth certificate after they had been formally registered as the child’s parents and, hence, had been granted this document on legal grounds? 
These and many other questions were completely ignored by the SURROGACY.RU “investigators”. It appears that an impartial assessment of the situation in the area of surrogacy services in Ukraine is not a part of the “detectives’” plan. 
 
Hence, what could be the real purpose of placing such publications at the SURROGACY.RU site?
 
The answer to this question can be found easily by making a comparative analysis of the methods applied by the Russian and Ukrainian companies that provide surrogacy services. 
 
As a rule, the Ukrainian companies only coordinate the action taken by patients, affording them an opportunity to take independent decisions. In this case, organization of interaction between patients, reproduction medicine clinic, surrogate mothers and the company, which controls the whole process is based on the principles of absolute transparency and mutual trust. The patients may contact, at any moment of time, each of the program parties, make all appropriate inquiries and correct their further action, depending on a situation. No attempt is ever made to keep them in the dark, restrict their right to make decisions, let alone taking decisions for them. Another important factor is that all the payments under a surrogacy program are to be made by patients step by step, i.e. patients should only effect payments for services actually provided in favor of particular service providers. 
 
The patients serviced by the Russian surrogacy centers are invited to:
  • have all business relationship, including the financial relationship, solely with companies who organize the whole process; 
  • invest any such above company with full power to solve all relevant issues independently, without a patient being involved;
  • make a single 100 % prepayment for the whole program, thus depriving clients of their right to cancel the contract and recover their money.
It may also be noted that the cost of a program in Russian Federation varies from U.S. $75,000 to U.S. $100,000, i.e. is 3-4 times higher than in Ukraine with its effectiveness being lower. 
 
The situation at large seems rather banal: it appears extremely important for Russian providers of reproductive services to reorient a flow of patients who, through impartial reasons, choose Ukraine. But how could it be done considering that surrogacy.ru writers are just incapable of offering more or less tangible preferences to potential clients? 
 
Hence, the only option left is to have recourse to outright lies and keep potential clients in fear of imaginary problems! 
 
As far as frauds are concerned, they do display their keen interest towards reproductive medicine, just as towards any other sphere of business. In this case, fraudulent action is taken both by providers and patients. And if providers try to extort as much money as possible from their clients for services that were not, in fact, provided, unscrupulous patients seek ways to dodge contract payments which are due to program coordinators, medical institutions and, in particular, surrogate mothers. 
 
However, any similar situations can be easily avoided in Ukraine. It would suffice just to choose a reliable, well-established Ukrainian company successfully operating on this market rather than choosing a “one-day”, or “black” go-between company, or seeking support through the agency of companies outside Ukraine.
 
The only conclusion that can be made to summarize the results of analysis of the SURROGACY.RU article is that there is no critical situation as regards surrogacy services in Ukraine, while the situations similar to those described by SURROGACY.RU journalists may only be given rise to by vivid imagination of their authors.
