FOR GENETIC PARENTS

One of the articles of Ukrainian legislation specifies clearly that after birth of a child the genetic parents shall be considered as the parents of this child. The full responsibilities and cares are to be placed on the parents of the child.

The surrogate mother is the donor used for birth of the child. She has no parental rights and obligations in relation to the child born in such a way. For realization of the surrogate motherhood program, the married couple shall conclude a contract with the Surrogate Mother specifying that by mutual consent, without any compulsion from either party, the parties agree the following:

• the genetic parents undertake to compensate to surrogate mother her services, food, accommodation (if required), examination of specialists, childbirth.
• surrogate mother undertakes to bear, give birth and transfer the legally born child to his or her genetic parents (meeting all the conditions specified in the contract).

The indications for carrying out treatment under the surrogate motherhood program are the following:

• congenital or acquired absence of uterus;
• absence or pathological deformation of uterine neck;
• pathology of uterus subject to no treatment;
• unsuccessful or repeated attempts of extracorporeal fertilization. Implantation of obtained viable embryo to the mother's uterus results in no pregnancy.
